DATA PROTECTION OFFICER

To facilitate relations between you, as the Data Subject, and the Controller, the latter has appointed a “data protection officer” (“DPO”).
You can freely contact the DPO at the email address privacy@infogestweb.it for all matters relating to the processing of your Personal Data and/or if you wish to exercise your rights, as indicated and described below.

WHY THIS DOCUMENT? TYPES OF DATA PROCESSED

The Regulation provides that, before proceeding with the processing of Personal Data, it is necessary for the person to whom such personal data belongs (hereinafter, the “Data Subject”) to be informed about the reasons for which such data are requested and how they will be used. This document therefore aims to provide you, in a simple and clear way, with all the information that will be useful to enable you to communicate your personal data to us knowingly and informedly and, at any time, to request and obtain clarifications and/or corrections and to exercise your rights.
This information is accompanied by a specific form (or web form) for confirming its viewing and acceptance, as well as for the eventual provision of consent.
For the purposes of this document, the term personal data refers to the definition contained in Article 4, point 1) of the Regulation, i.e., “any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person” (hereinafter “Personal Data”).
The Personal Data processed by the Controller are as follows: personal contact and common data, including name, surname, company of belonging, e-mail address, telephone number, residential address, any additional personalized message sent to the Controller via the online form.

PURPOSES OF PROCESSING

Your personal data will be processed only for the following purposes:

  • For the operational management of our Website. This means that we process your Personal Data (especially the Data we automatically collect during your Browse) to allow the Website you are using to function and to improve its performance.
  • For the management of the security of your Data and our Website. Ensuring the security of your Data and the Website is our contractual and legal duty. We strive to make our web spaces an increasingly secure place for our users.
  • For the processing of entirely anonymous statistics. IGW carries out, also through the use of services provided by third parties, anonymous statistical analyses regarding the use of its Website. These are analyses, carried out at an aggregated and, therefore, anonymous level, which allow us to understand fundamental aspects related to the use of the Website and without which we would not be able to improve or update the services we offer.
  • Protection or defense of rights in court. We may process your Personal Data to protect or defend our right before a judge, or other competent authorities.
  • Fulfillment of obligations under current laws or regulations. This means that, when the law imposes certain obligations on us that involve the processing of your Personal Data, we will have to proceed with such processing for the purposes provided for by the law itself.
  • Provision of requested services and information about new services. Whenever you wish to use the services we offer, want to participate in initiatives promoted by us or activate new services or even simply receive more information about our areas of activity, we will process your Personal Data, as entered in the form on the Website, to provide you with what you request and, therefore, we will process your Data to fulfill our contractual and pre-contractual obligations and in any case only upon your request in this regard. In particular, we may collect your Personal Data through online forms on the Website relating to your request to receive a “demo” of our services, or if you request to subscribe to our newsletter;
  • Detection of the quality of services offered, statistical surveys, however preferably based on aggregated data;
  • Promotional, informative, and awareness-raising communications directly connected and functional to the services offered by the Controller;
  • Commercial communications relating to goods or services provided by third parties of a nature similar to the services offered by the Controller;
  • Sharing and communication of your Personal Data to third-party companies, possibly part of the same corporate group as the Controller, for commercial purposes.

 

THE LEGAL BASIS OF OUR DATA PROCESSING IS:

Art. 6, paragraph 1 letters b), c) and letter f) of EU Regulation 2016/679 for the purposes indicated above in points 1, 2, 3, 4, 5, 6, 7 and 8. In particular, purposes 7 and 8 are also based on our legitimate interest in evaluating the service provided, preparing promotional material for other potential customers, also through the use of anonymized data and carrying out promotional, informative, and awareness-raising communications regarding services and goods directly attributable and functional to the service rendered. In the event of sending newsletters to the data subject, the latter will in any case always have the right to exercise the so-called opt-out, i.e., to communicate their willingness not to receive other communications of that type and to be removed from any mailing lists. In this regard, the data subject may exercise this right either through the channels indicated in this information notice or by following the instructions present in each newsletter email received.
Purposes 9 and 10 are subject to the legal basis of consent pursuant to art. 6, paragraph 1, letter a).

MANDATORY OR OPTIONAL NATURE OF DATA PROVISION, CONSEQUENCES OF A POSSIBLE REFUSAL

For the purposes indicated in numbers 1 to 5, the provision of your personal data is mandatory, because otherwise we will not be able to correctly manage our Website or fulfill any legal obligations. For purposes 6 to 10, the provision is optional; in particular, for purposes 6 to 8, you may at any time object to the processing (so-called opt-out) and we will be obliged to stop using your personal data for these purposes. For purposes 9 and 10, consent is optional and can always be freely revoked; in particular, such consent will not last longer than 3 years from the provision of consent, unless you indicate otherwise, in which case the Controller will immediately stop the processing.

METHOD OF PROCESSING

Processing will be carried out mainly with the aid of electronic tools. Your data will be processed under the authority of the Controller, only by specifically appointed, authorized, and instructed persons for processing pursuant to art. 29 of EU Reg. 2016/679. Adequate security measures will be observed pursuant to arts. 5 and 32 of EU Regulation 2016/679 to prevent the loss of your data, unlawful or incorrect use, unauthorized access, accidental deletion. Each data processor is bound by the principles of lawfulness and confidentiality in processing. Your personal data is processed in compliance with applicable law and using adequate security measures, in accordance with current legislation also pursuant to arts. 5 and 32 of EU Regulation 2016/679.

TO WHOM CAN WE TRANSMIT YOUR PERSONAL DATA?

Your personal data may be communicated within the EU, in full compliance with EU Regulation 2016/679, to the following subjects: public authorities, where required by law or at their request; external structures and/or companies that the Controller uses to carry out related or instrumental activities; other companies of the group to which it belongs, external consultants. The Controller will appoint as data processors pursuant to art. 28 the third parties who process data on its behalf and for its account.

DURATION OF PROCESSING

Without prejudice to legal obligations, the personal data we process will be stored for a determined period, based on the needs of jurisdictional protection of rights and contractual needs and obligations, also established by law and in any case for all the time useful to manage the service and subject to legal prescription terms, the duration of your consent indicated above and your right to request the interruption of processing at any time.

YOUR RIGHTS

At any time, you may exercise the rights referred to in articles 15, 16, 17, 18, 20 and 21 of EU Regulation 2016/679, by sending us a written communication to the following email address: privacy@infogestweb.it. You may request: confirmation of the existence or otherwise of your personal data in our databases, verification of their accuracy or request their updating, rectification, integration, access, rectification, deletion of your personal data or restriction of processing, deletion, anonymization or blocking of your personal data, if you believe they are processed in violation of the law.
